Offer Letter

An offer letter is issued before the candidate joins — confirming the role, compensation, and conditions of employment. Offer letter is the first formal document in the employment relationship. Get it wrong and you set up misaligned expectations from Day 1.

Under the new Labour Codes, the offer letter must reflect the correct wage structure — basic salary must be at least 50% of total CTC under the Code on Wages. An allowance-heavy salary structure that loads pay into HRA and special allowance no longer holds up during inspection.

Appointment Letter

An appointment letter is issued on or after the joining date — it is now legally mandatory for every worker in India under the Labour Codes effective November 21, 2025.

Before November 2025, many small companies skipped the appointment letter for blue-collar workers, daily wage staff, and contract employees. That approach is no longer legally defensible. Every worker — regardless of role, salary, or employment type — must receive a written appointment letter. The appointment letter is also what EPFO and ESIC inspectors ask for during audits.

Confirmation Letter

A confirmation letter is issued at the end of the probation period — confirming the employee’s permanent status, updated notice period, and any salary revision that applies post-confirmation.

This creates a specific legal risk: courts in several Indian states have held that an employee who was never formally confirmed — and never formally extended on probation — is effectively a confirmed employee after a “reasonable period.” Which means the company loses the ability to terminate with shorter notice.

Increment / Salary Revision Letter

An increment letter documents the revised compensation — including the new salary structure, effective date, and hike percentage. It is the employee’s proof of salary revision for bank loans, visa applications, and future employment.

The increment letter matters beyond the moment of issuance. Employees use it for home loans, car loans, and rental agreements — often months after the revision. If the letter has the wrong CTC or the wrong effective date, the employee comes back to HR, sometimes in the middle of a loan closure. Under the 50% basic salary rule post-Labor Codes 2025, increment letters must also reflect revised salary structures where basic has been adjusted.

Experience Certificate

An experience certificate confirms the employee’s tenure, designation, and a standard line about their conduct — issued on or after their last working day. Background verification agencies treat it as primary employment proof. Experience certificates are the document most frequently requested by employees — and most frequently delayed by companies.

The delay usually isn’t intentional. HR is waiting for clearances. The manager hasn’t approved the content. The template is somewhere on a shared drive. By the time it’s ready, the employee has already joined their new company and is chasing from the other side.

Relieving Letter

A relieving letter confirms that the employee has completed exit formalities and has been formally released from their duties — separate from the experience certificate and required for background verification.

The relieving letter says: this person resigned, served notice, completed handover, and has been released. It’s the formal end of the employment contract. Background verification processes check for it specifically — because it confirms there are no pending obligations or disputes between the employer and the departing employee. Under the Labour Codes 2025, FnF settlement must be completed within two working days of the last working day.

Warning Letter

A warning letter is a formal disciplinary document issued to an employee for misconduct, policy violation, or performance issues

A warning letter must be specific — which policy was violated, on which date, what the expected behavior is, and what the consequence of repetition will be. Vague warning letters (“your performance has not been satisfactory”) offer little legal protection. The warning letter also gives the employee a fair opportunity to improve — which is both the right thing to do and the legally defensible approach.

Termination Letter

A termination letter formally ends the employment relationship — stating the effective date, reason for termination, and any outstanding dues. Termination letters are the most legally sensitive HR document. Key requirements: the termination must be for a valid documented reason (misconduct, performance, redundancy, or contractual end).

The notice period specified in the appointment letter must either be served or compensated. Outstanding salary and FnF must be settled per the Labour Codes timeline.
